1. Acceptance of these terms

These Terms of Use govern your access to and use of www.daxosdigit.com (the “Site”), operated by daXos LLC, a North Carolina limited liability company (United States) (“daXos”). By using the Site you agree to these Terms. If you do not agree, please do not use the Site.

2. About the Site

The Site provides general information about daXos and its products and services. Its content is for information only and does not constitute an offer, a binding quotation, or a contract. Any pilot, purchase or commercial engagement is governed by a separate written agreement between you and daXos.

3. Permitted use

You may use the Site for lawful personal and business informational purposes. You agree not to: use the Site in breach of any law; attempt to gain unauthorised access to it or its systems; scrape, harvest or extract data by automated means without our prior written consent; interfere with its operation or security; or copy, reproduce or reverse-engineer any part of it except as permitted by law.

All content on the Site — text, graphics, images, layout, logos, and the “daXos” name and marks — is owned by daXos or its licensors and is protected by intellectual-property laws. You are granted a limited right to view the Site for the purposes above. No other right or licence is granted, and you may not use the daXos name or marks without our prior written permission.

When you submit information through our forms (for example a pilot request or white-paper request), you confirm that it is accurate and that you are entitled to provide it. Do not submit confidential information, or another person’s personal data, unless you are authorised to do so. You grant daXos the right to use the information you submit to respond to your request, as described in our Privacy Policy.

The Site may link to third-party websites or services. We provide these links for convenience and are not responsible for the content, accuracy or practices of those third parties.

7. No warranties

The Site is provided “as is” and “as available”. To the maximum extent permitted by law, daXos makes no warranties of any kind regarding the Site, including as to accuracy, completeness, or uninterrupted availability. Technical figures, specifications and performance statements on the Site are indicative and may change without notice.

8. Limitation of liability

To the maximum extent permitted by law, daXos shall not be liable for any indirect, incidental, special or consequential damages arising out of or in connection with your use of, or inability to use, the Site. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.

9. Privacy

Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.

10. Governing law

These Terms, and any dispute arising out of them or your use of the Site, are governed by the laws of the State of North Carolina, USA, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in North Carolina. Any mandatory consumer-protection rights you have in your country of residence are not affected. daXos does not currently maintain an establishment or representative in Europe.

11. Changes to these terms

We may update these Terms from time to time. The “last updated” date above shows the current version; your continued use of the Site after changes means you accept them.
